GENERAL TERMS AND CONDITIONS


  1. Scope of application

Unless otherwise specified, these General Terms and Conditions of Beakon Global GmbH (hereinafter referred to as "Beakon Global") apply to all offers made by Beakon Global for the application of travel insurance policies on the online purchase website www.beakonglobal.com (hereinafter referred to as "online application"). The customer has the opportunity to carry out an independent and free comparison of certain travel insurance products from different insurance companies and to submit insurance applications online.

    These General Terms and Conditions apply exclusively if the customer is a consumer. A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed primarily to their commercial or independent professional activity.

    Beakon Global GmbH is an international insurance broker and is licensed in accordance with
    § 34 d para. 1 of the German Trade, Commerce and Industry Regulation Act. In case of an insurance claim, the customer must contact the insurance company directly.

  5. Insurance contract, contract language, correction option, storage of contract text and insurance policy
  6. 3.1 The customer is guided through the online application process. Beakon Global provides the customer with free and non-binding information about rates and conditions of insurance companies cooperating with Beakon Global for travel insurance Beakon Global uses the online application portal to broker insurance contracts from the respective insurance companies on the basis of the offer selected by the customer. The customer can obtain an overview on the basis of the data and criteria they provide and select the appropriate travel insurance product online and submit an application.

    3.2 As soon as the customer has selected the travel insurance product, they can conclude the insurance contract with the selected insurance company by clicking on the "Conclude with obligation to pay" button. The contract is concluded exclusively with the respective insurance company and the general and special insurance conditions, any tariff regulations and any separate agreements form the basis of the insurance contract between the customer and the respective insurance company. The respective insurance company alone shall decide whether to accept an insurance application from the customer.

    3.3 The language available for the conclusion of the contract is English.

    3.4 Before the customer clicks on "Complete with obligation to pay", the details must be checked and, if necessary, corrected. The customer must ensure that all necessary information fields and personal details as well as contact details are filled in carefully and correctly, in particular with regard to the correct spelling and indication of the date for the required insurance policy and travel period. It is no longer possible to change the data and details afterwards.

    3.5 Beakon Global stores the online contract data. After conclusion of the contract, the customer receives a confirmation including insurance policy, general terms and conditions as well as insurance conditions and consumer information of the respective insurance company by email. In addition, all documents can be downloaded via the "Download insurance documents" button.

  7. Payment, Prices and invoicing
  8. 4.1 Payment is made via Mastercard, Visa, American Express, China UnionPay, Discover & Diners Club, eftpos Australia or Japan Credit Bureau and the credit card account is debited when the purchase is completed online.

    4.2 Beakon Global will collect all payments on behalf of the insurance companies.

    4.3 When paying via the payment methods mentioned under 4.1, the purchase price claim is transferred to
    Stripe Payments Europe, Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210 Ireland as payment processor operating for Beakon Global. The data required for payment processing will be transferred to Stripe Payments Europe, Limited. The provision of the data is necessary for the conclusion of the contract. Failure to provide the data means that the contract cannot be concluded.

    Further information can be found in the data protection provisions of the payment service provider ( https://stripe.com/de-en /privacy).

    4.4 All prices are in Euros and incl. taxes.

  9. No contradictory national laws
  10. The customer warrants that he is entitled to take out travel insurance abroad in accordance with the local laws of his home country. Beakon Global is not liable for the review of the customer’s national laws and any resulting claims.

  11. Tariffs of the insurance company
  12. Beakon Global endeavours to ensure that the information on the insurance companies' rates and conditions are always up to date, complete and correct. However, the information is provided without guarantee.

  13. Rejected visa application
  14. If the customer has applied for a visa via VFS Global and the visa is rejected, the customer may cancel this contract within fourteen days of receiving the rejection notice. The customer must contact Beakon Global in writing by email iassistgo@ptnr.beakon.global and submit the official rejection notice from the embassy so that Beakon Global can check the cancellation and inform the insurance company accordingly. Once the insurance company has confirmed the reversal, Beakon Global will refund the payments received to the customer, with exception of the costs incurred for payment processing with the Payment Gateway. Beakon Global will refund the payments received less a lump sum of 3,5 % of the amount paid.

  15. Liability of Beakon Global as an intermediary
  16. 8.1 Beakon Global has unlimited liability in the event of intent and gross negligence.

    8.2 In the case of simple negligence, Beakon Global is only liable if it is a breach of a primary obligation or a secondary obligation, the breach of which jeopardises the achievement of the purpose of the contract or the fulfilment of which makes the proper execution of the contract possible in the first place and on the observance of which the customer could rely. In this case, Beakon Global's liability is limited to the damage typical of the contract and foreseeable at the time the contract was concluded.

    8.3 Insofar as the liability of Beakon Global is excluded or limited, this also applies to the personal liability of legal representatives, employees and vicarious agents of Beakon Global.

    8.4 Any claims for damages arising from the breach of an obligation pursuant to § 60 or § 61 in conjunction with § 63 of the German Insurance Contract Act remain unaffected.

  17. Links to third party websites
  18. The website may contain hyperlinks to websites operated by third parties (e.g. insurance companies). Such hyperlinks are provided to the customer for information purposes only and Beakon Global is not responsible for their content.

  19. Data protection notice
  20. Beakon Global processes the customer's personal data for the purpose of fulfilling the contract. The data is passed on to the respective insurance company and to service providers acting on behalf of Beakon Global for the fulfilment of the contract and the subsequent support and administration of the insurance contract.

    The customer agrees that Beakon Global may pass on the data collected, processed and stored to any legal successor of Beakon Global or a purchaser of the insurance portfolio.

  21. Applicable law, note on participation in disputes, severability clause
  22. 11.1 These General Terms and Conditions are subject to the law of the Federal Republic of Germany, whereby mandatory provisions of the consumer's country of residence remain applicable.

    11.2 The European Commission provides a platform for online dispute resolution (ODR). You can find this platform at the following link: https://ec.europa.eu/consumers/odr/. Consumers can use this platform to resolve their disputes arising from online contracts.

    11.3 Should individual provisions of these General Terms and Conditions be invalid, this shall not affect the validity of these General Terms and Conditions. Invalid provisions shall be reinterpreted in such a way that the economic purpose intended by this provision is achieved.
